TERMS & CONDITIONS OF SALE

Section 1

These Terms and Conditions of Sale are governed by Articles 1125 et seq. of the French Civil Code and the French Consumer Code.

The purpose of these Terms and Conditions is to define the rights and obligations of French Art Treasures and the customer. They apply without restriction or reservations to the purchases made by customers on our website www.frencharttrasures.com (throughout this document called, the website or the site).

French Art Treasures reserves the right to update, adapt or modify these Terms and Conditions any time. In case of modification, only the Terms and Conditions in force on the day of the order shall apply.  At the time of ordering, the customer acknowledges having read and accepted these Terms and Conditions of Sale.

Section 3: Purchaser

​

Only persons legally able to enter into contracts concerning the items offered by French Art Treasures on the website may place an order. When placing an order, you must have the full legal capacity to adhere to these Terms and Conditions.

 

When you pay by credit card, you declare that you are fully authorised to use the card that you pay with.

The selection of items from French Art Treasures proposed in the context of distance selling is available on the website. We sell one of a kind unique vintage items. Items are only available for sale via the internet. Payment must be made via the website.

​Any order made on the website warrants the buyer's full and unreserved acceptance of these Terms and Conditions.  After confirming the contents of your order, you agree to pay the price, you will have to choose from the means of payment proposed by French Art Treasures on the website and pay.  â€‹â€‹The sale will be considered definitive (no cancellations) once the customer has completed payment and French Art Treasures has sent an order confirmation by email.

Section 4: Prices

​

The prices of the items appearing on the website are indicated in euros and are shown in other currencies.

 

Occasionally, French Art Treasures will offer promotional codes but these codes are time specific and we do not guarantee their acceptance.

The items remain the property of French Art Treasures until receipt of full payment and French Art Treasures is not responsible for any customs duties or taxes that the buyer may be subject to.

 

Section 5: Payment

​

Your order will be shipped upon verification of the payment method you have chosen.  French Art Treasures reserves the right to refuse any delivery in case of refusal of authorisation of payment by credit card from officially accredited bodies, in case of non-payment and in case of legitimate reasons to doubt your means of payment.

 

Section 6: Shipping

​

We wrap and box every painting carefully and with due diligence. We usually send stock with the LaPoste's COLISSIMO or CHRONOPOST services. These are incredibly reliable and we have successfully shipped hundreds of paintings all over the world with them. Once your parcel is sent you will receive a track and trace number. You can of course ask us at anytime on the progress of the shipment. Buyers are responsible for any customs and import taxes that may apply.  At this time, we offer FREE worldwide shipping but withhold the right to change this policy without notice.

All our paintings leave with the correct paperwork including an individualised customs passport and copies of the invoice. We are registered on platforms such as EORI (for UK and Swiss imports) and the German LUCID packaging database to enable quick shipping and reduce delays. We will help you to track your painting through customs if there are any undue delays. However, we are not responsible for any delays. Any applicable custom duties and/or taxes are the responsibility of the buyer.

In the unlikely case that something goes wrong and your package and the contents are damaged you should notify us and the company that delivered your package within 48 hours. Do not throw away the box, it could help to prove the deliverer's liability and you may need it to return the painting. Take multiple photos of the box and the contents and complete a claim form with the deliverer. Send us a copy of the claim form for a refund. PLEASE NOTE: I do not refund for unclaimed or undeliverable packages due to absence or incorrect/incomplete addresses etc.

PLEASE NOTE: Antique and vintage frames are wrapped with extreme care, usually with foam edging to protect plaster and gilt frames, but they are often fragile and can potentially arrive slightly damaged during transit, for instance some moulding or plaster on the frame may become loose, this is usually easily repaired with glue. We will do our best to advise on repairs but it is important to note that but we do not replace frames that have been suffered minor or additional losses during transit due to movement and fragility.

 

Section 7: Returns

We understand that you may have a change of heart about your painting once you have it in your home, our returns policy is as follows:

For customers within the EUIf you want to return a painting you must notify us and return the piece within 14 days from the date that you received it.  You must pay the return postage costs (non refundable) and we recommend that you insure and track it as we cannot be responsible for any losses during transport.  Once we have received the item, subject to it being in the same condition that it was in when it was sent to you, you will be reimbursed the total of your order.   Note: We do not offer refunds for sales goods/goods sold at a discount

 

For customers everywhere elseIf you want to return a painting you must notify us and return the piece within 7 days from the date that you received it.  You must pay the return postage costs (non refundable) and we recommend that you insure and track it as we cannot be responsible for any losses during transport.  Once we have received the item, subject to it being in the same condition that it was in when it was sent to you, you will be reimbursed the total of your order, less the original shipping costs and a 15% restocking fee.   We do not offer refunds for sales goods.
